New video surfaces in death of Jeremy Marr, AG rules KSP not in violation of Open Records Act

GLASGOW, Ky. – Kentucky State Police continues to investigate the death of Jeremy S. Marr, a Glasgow man who died while in Glasgow Police’s custody in April.

WCLU News requested several records related to the investigation, but those records were denied because of the “active investigation,” which began April 14, after Marr died.

Given that the agency continues to deny the open records request, WCLU News filed an appeal through the Kentucky Attorney General’s office, which decided KSP did not violate the Open Records Act by denying any of the records requested.

“KRS 61.878(1)(h) permits a law enforcement agency to deny a request for investigative records obtained by a law enforcement agency during a criminal investigation if premature disclosure of those records will cause harm to the investigation,” a letter from the attorney general’s office said.

The records requested included a medical examiner’s report determining Marr’s death; any video footage, including nearby substation security footage and body camera footage; and the 911 CAD report in question.

Marr was purportedly involved in an unknown altercation with Glasgow Police before he died. It’s unclear how Marr died or whether the incidence with GPD led to his death.

However, a video later surfaced from a nearby individual that shows police using force while subduing Marr. The video shows an officer issuing several blows with his knee to Marr’s back.

Another video, which was requested from KSP, was captured from a substation along Cleveland Avenue belonging to the Glasgow Electric Plant Board.

The agency denied the request, however, WCLU News obtained that video from the Glasgow Electric Plant Board through an open records request.

Marr is captured in the video, before the altercation with police, running in the roadway on S.L. Rogers Wells Boulevard. Marr is later seen running into the yard of the home along Cleveland Avenue where he was involved in an altercation with GPD.

The attorney general’s office states that all records requested by WCLU News “are intelligence [or] investigative reports.”

It’s unclear when any details will be released from the investigation. Marr’s death continues to be an uncertainty, given that neither officers nor information related to the case have been made available to the public.
