Thomas Wayne Houchens appeared in Barren County Circuit Court on Tuesday, April 1, where his counsel asked that his bond be reduced based on access to quality medical care.

Resa Gardner, assistant commonwealth’s attorney, said she opposed the reduction. She said Houchens presents a danger to the community and, because the alleged victim is his mother, it was unclear where he’d stay if released.

“We would oppose any modifications,” Gardner said. “Mr. Houchens has a prior arson conviction…the property belonged to his mother, and after talking with his mother, she does not want him out. She doesn’t feel safe if he was out. He was able to commit this crime while having these medical issues.”

“I think where the bond is set is appropriate for the charges,” she added.

Judge John Alexander said he would not reduce bond at this point because he, too, was unsure where Houchens would go and had no reason to believe he wasn’t getting adequate medical attention in jail, though Houchens’ counsel said he reported “struggling to get care.”

“He is not receiving the care he’s received out of custody regarding his issues,” said Houchens’ attorney Lauren Hunter.

“All I got to do is go to a church,” Houchens said in response to Alexander’s uncertainty regarding his location if released.

Houchens was recently indicted by a Barren County grand jury on charges of second-degree arson, first-degree criminal mischief and first-degree persistent felony offender for setting fire to a residential garage at 3219 Lyon School Road.

Houchens’ bond is set at $20,000 cash.
